Conference "At the frontiers of public procurement" with Gauthier ERVYN

Gauthier ERVYN will speak at the conference "At the frontiers of public procurement" organised on 12 and 19 November 2020 by the Brussels Young Bar Conference and the publisher LARCIER. He will give a presentation on "the European transparency obligation", namely the application of the principles of equality, transparency and non-discrimination to unilateral acts and contracts that are not public contracts, and that are concluded by public authorities and other entities directed, financed or controlled for the most part by public authorities. As a result of this study, he notes that a great many unilateral acts (authorisations, subsidies, etc.) or bilateral acts (real estate contracts, public-property concessions, etc.) are subject to a competitive regime, whether these acts emanate from purely administrative authorities or from semi-public entities. Moreover, where these obligations are not complied with, the nullity of the unlawful acts may be invoked in court by third parties.
